The Terms & Conditions as laid out here would be the basis of your dealing with www.thetravelobuddy.com and will cover all bookings. So kindly go through this policy document that sets out your rights and obligations. This contract is with TheTraveloBuddy registered office at 954 LEXINGTON AVE, NUM 1051 NY New United States 10021.
Your Holiday Contract
While making a booking, please ensure that you are authorized to accept it or are given the authority to accept it on behalf of other members of the party. The contract comes into action soon as we accept a deposit and give you a confirmation invoice. (There are cases where you will be asked to make a complete payment for which you would be advised at the time of respective booking). This contract would be governed as per the English Law and would be under the jurisdiction of the English Courts. However, you may wish to choose the jurisdiction of the courts of Scotland or Northern Ireland.
Important: It will be your responsibility to see whether the information as mentioned on the confirmation invoice is accurate and subsequently bring any discrepancy to our notice at the earliest. We won’t be liable for any wrong information printed on your ticket(s).
Your Financial Protection
We give full financial safeguard for these package holidays. While you purchase a TTA protected package with us, you get a confirmation invoice that would confirm your travel arrangements and ensure travel protection. In the unlikely event of insolvency, TTA ensures that the passenger is not stranded abroad and arranges adequate refund for the payment made. Your Holiday Price
- We hold the prerogative to alter holiday prices mentioned on our website. We will advise the current price for the requested holiday prior to the confirmation of your contract.
- The fares mentioned on this website are for flights and 7 Night stay for 2 adults & 2 children. These are inclusive of all prepaid fees and taxes.
- As you decide to go ahead with a booking, you would be required to pay a deposit. (for ticketing time limits, full prices are applicable; this would be advised at the time of flight booking). You must pay the balance twelve weeks before the departure date, failing which, we may cancel your travel arrangements and retain your deposit.
- Changes associated with transportation costs, including landing taxes, fuel costs, or embarkation/disembarkation fees at airports, could be made even after the completion of flight booking.
- For payments made by cheques, just ensure that it is payable to "TheTraveloBuddy.com account".
Balance
The balance must be paid 12 weeks before the departure or before the due date as mentioned on the confirmation invoice. The balance must be paid within the stipulated time, and your inability to make the required payment may lead to booking cancellation where you would have to pay the cancellation charges.
If You Change Your Booking
If you plan to change your travel arrangements after the issuance of confirmation invoice, we will try to implement such changes, but cannot guarantee the same. Request for changes must be made in writing by the person who made the booking at the first place. An administration fee of $25.00/person would be applicable for this, atop of any costs incurred by us to make such changes. These costs might increase as the departure date approaches, and you may feel free to contact us for this. Note: There are a few travel arrangements which may not be changed after completion of reservation. Changes in such cases may require you to pay 100% of the booking prices. Kindly go through the cancellation conditions and date changes as mentioned in the booking confirmation.
Pricing Errors
We make every inch of effort to make sure the prices mentioned on this website are accurate, however, few errors may still come up in the process. And if we come across these errors, you would be duly notified about the same within 7 days of booking time, or if detected later, at the earliest. In cases where the booking is not complete, you will get the choice to continue with same fare where alternative fare is less than that which was provided earlier. Where we find it necessary to cancel your booking, we would pay the compensation that would be decided there and then. Where we make major changes to your travel, and where there is sufficient time for your departure, we would inform you about the same as soon as possible. You may then choose to accept an alternate holiday offer of comparable standard, if available (any price difference would be refunded if the alternate option is of a lower value), or cancel it to receive refund for all monies paid. At the same time, in every case, except changes due to force majeure, we will provide adequate compensation for the same.
Force Majeure
In cases of cancellations or changes due to unforeseeable circumstances that are beyond our control, we won’t be able to compensate for the same. These causes include, inter-alia, terrorist activities, war, industrial dispute, riot, fire, natural/nuclear disaster, adverse weather conditions, pandemics/epidemics, and indispensable technical problems associated with transport.
If You Have A Complaint
For any problem during your holiday, you may inform the respective supplier (e.g., agent, hotelier, local, etc.) immediately. Where your problem is not resolved locally, you may then check with us within 28 days of your return journey by writing to our Customer Service Department at TheTraveloBuddy Private Limited, 954 LEXINGTON AVE, NUM 1051 NY New United States 10021, and giving your booking reference number and other relevant details. You may also mail us at support@thetravelobuddy.com Where you fail to inform us accordingly, then we may be deprived of the opportunity to look into the matter and could challenge your right as per this contract.
Our Liability To You
If the contract is not properly honored on our part or by the respective supplier, then we will arrange appropriate compensation where the services being delivered are not properly utilized. However, this liability won’t extend to cases of non-performance of the obligations on your part, or where such glitches are unforeseeable or unavoidable; or unforeseeable scenario beyond our control, whose dire consequences could not have been avoided in any possible way, or where either we or our suppliers couldn’t have foreseen it at the first place.
Except in cases that involve injury, death, or illness, we shall be liable to a maximum of 0.5 times the cost of your travel arrangement. This liability would be limited in accordance with:
- The terms of contract of the companies providing the travel transportation arrangements. Such terms are properly mentioned in this contract; and
- Relevant international conventions, including the Montreal Convention for air travel, the Athens Convention for sea travel, the Berne Convention for rail travel and the Paris Convention for accommodation provisions, which limits the compensation amount that you may claim for injury, death, and delay to passengers or damage, loss and luggage delay.
You can request for copies of contractual terms of the transport companies, or of the relevant international conventions, from our offices at 954 LEXINGTON AVE, NUM 1051 NY New United States 10021. As per the EU law (Regulations 261/2004), you hold the rights in circumstances related to refunds and/or compensation by the airline where you are denied boarding, or for cases pertaining to cancellations or delays. EU airports publicize the complete details of such rights and you may also get these from the airlines you are flying with. However, compensation terms in such cases won’t automatically make you eligible for refund of your entire holiday costs.
Quick Assistance While in Resort
If this contract that we have with you isn’t honored or is not adequately performed because of failures that are attributed to a third party not connected with performance of such services, or due to failures associated with unforeseeable or unusual circumstances that are beyond our control, the results of which may not be avoided even where due care is taken, or an incident which we, even with total supervision, could not forestall or foresee, and which results in your suffering, injury or other material losses, we will come forward with quick assistance that would be reasonable under such circumstances.
Passport, Visa and Immigration Requirements
Your visa and passport requirements, and other relevant immigration formalities are your own responsibility for which you must check with the relevant Embassies and/or Consulates. We won’t be responsible in cases where you cannot travel due to your non-compliance with respect to any visa, passport or immigration requirement.
Note: Customers not having passports marked as “British Citizen” must go through the relevant requirements with the respective Consulate or Embassy of the visiting country or with the British Foreign Office. Also ensure that you have complied with the necessary passport and visa requirements and have adequate time to obtain them.
Those travelling through or via US are required to carry a machine readable passport. All children should also possess passports of their own, especially while visiting the U.S. A passport must be valid for a minimum of six months from the end of journey.
Note: Those visiting the United States can apply for a visa before their scheduled departure on the following website - https://esta.cbp.dhs.gov (charges are applicable for this service).
For latest updates on visa-related requirements to other places or regional conflicts, we would recommend you to visit the Foreign Commonwealth office website http://www.fco.gov.uk or call on 0207 270 1500. There may be some changes in recommended inoculations for travel and we request you to consult your doctor or the respective Embassy or Consulate for the latest update. Do ensure that you have all the required inoculations for your trip.
Flights
Flight numbers, details of airlines, and destination airport would be mentioned on your confirmation invoice. Kindly note here that no airline could guarantee flight departure times and they may change due to air traffic control restrictions, inclement weather conditions, and operational/technical problems. We are not liable for any change to your arrival/departure time as mentioned in your confirmation mail. So it would be better to check your flight departure time 72 hours before your departure time. If the flight is delayed, TheTraveloBuddy would be unable to make any special arrangements for the passengers since it is the sole responsibility of the airline or their agents charged with ground handling. We cannot guarantee any specific aircraft types or a preferred seat.
Insurance
Since we are not liable for flight cancellations, delays, lost or delayed luggage, natural disasters, or industrial disputes, it is hereby expressed in this contract that you and other members of your party will be adequately insured.
Excursions
Excursions or other tours that you choose while on your holiday are not included in the holiday package that you book with us. So any contract dictating the terms of contract for such excursion or any other tour booked locally would be with the operator providing that excursion and we won’t be responsible for any mishap during the course of your excursion.
Medical Problems and Special Requests
In case of special requests (e.g., inter-connecting rooms, low/high floor, etc.), kindly bring the same to our notice at the time of flight booking. We will take your request to the respective supplier, but we cannot guarantee such services prior to departure. Similarly, any failure to deliver on your special request will not be taken as any breach of contract from our end. For medical conditions or disabilities that could affect your travel arrangements, do notify us about it in writing along with full details. Similarly, if we cannot accommodate your particular requirements, we will have the prerogative to decline your booking but at the same time, and every effort would be made to provide necessary assistance wherever possible.
Ticket Dispatch
Kindly note that you would be receiving an email entailing your e-ticket for whichever route the service is available. It is primarily an electronically generated paperless ticket stored in the airline booking system.
Your documents for travel include your e-ticket, transfer voucher, accommodation voucher, etc. These will be emailed to the member of the party who has booked the ticket in about 10-14 days prior to flight departure and won’t be released until full payment has been made. Then you may expect an email itinerary which are to be passed pass onto other members of the party, who in turn, are expected to verify these details along with their acceptable forms of identification.
Note: Acceptable forms of identification include passports or any relevant Travel Document issued by the authorities in lieu of passport.
Credit Cards
At least one member of the party travel is required to travel with an authorized credit card which would be required at the time of hotel check-in or for car rentals.
Map/Distance Disclaimer
The information related to the travel distances hotel locations on the maps are provided for indicative purposes only. Those who require an accommodation within the proximity of city-center or any particular location could check-in directly through the hotel website.
Behavior
It would be responsibility of the party leader to ensure that there is no misbehavior on the part of any member of the party which may harm others or could risk property damage. In these circumstances, the suppliers (e.g., airlines, hotel, transfer agent, etc.) will have the right to cancel the arrangement that is made by us on your behalf and would further nullify this contract with you. Further, you would be held liable to reimburse any expense that is incurred as a result of your misdeed.
Departure Taxes
It won’t be always possible for us to include departure taxes in your ticket – there may be a case where these taxes must be paid at the local level and directly payable to the Government of the visited country. Such taxes are usually non-refundable.
Pre-travel advice
There might be some information issued by the Foreign Commonwealth Travel Advice Unit about your holiday destination. You may check with this on BBC (Cefax) page 470 or on their official website www.fco.gov.uk.
Telephone Calls
Please note here that we may randomly record the telephone calls you make or receive for your holiday reservation. It enables us to improve our service accordingly.
Hotel and Cruise Ship Ratings
All the hotel and cruise ratings mentioned anywhere on the TheTraveloBuddy web site are meant as a general guide are not representative of any official grading system. There may be some variations in the actual standards of hotels within same grade in different countries and in some cases, even within the same country. For example, a hotel rated as 5-star in one country may not necessarily be of the same standard as a 5-star hotel in another country.
Kindly note here that hotels and cruise ships booked here are not exclusive to TheTraveloBuddy. We won’t be responsible for non-provision of any facility due to other guests in a hotel or a ship, or due to their activities. TheTraveloBuddy will not be responsible for any feature of hotel or cruise service as displayed on this website. These facilities and other property features may change without any prior notification to TheTraveloBuddy. Images of cabin or room types may not necessarily represent the exact configuration of the room. E.g., quad room in North America could consist of 2 double beds and a room for two, whereas, the same in Europe would only have two single beds. Further, the hotel may charge an additional fee for extra cot or bed. We expect our customers to inform us about any special requirement in this regard at the time of holiday booking. This request would be forwarded to the respective supplier, but we cannot guarantee the same and it doesn’t form a part of this contract.
Carrying Proof of Booking
Please ensure that you are travelling with all necessary documents required for your travel. These include e-tickets, booking confirmation, or any other travel documentation (passport and relevant visa) . We won’t be liable in cases where any supplier is not able to render any service under the booked product or service due to your inability to provide these documents.
Information Shared With Us
We may collect your computer information for calibrating the ad effectiveness. We also collect information about any visit TheTraveloBuddy.com The information is collected on the basis of your browsing activities.
Such information may include products or services viewed/booked. This is meant to enable us to come up with effective offers that are tailored as per your travel needs and in a personalized manner. This information could be used for measuring the entry and exit points to different pages and sections of our site and related details associated with product searches. Further, it could also be used to analyze our advertising banners and use them effectively. The aggregate of this information could be shared with the third parties and would not be shared as personal information.
Those subscribing to our e-mail newsletters can expect promotional e-mails from our end. You may choose to opt out from it at any point of time by making a written request to our Data Controller or sending a formal request at 'privacy@thetravelobuddy.com'. You may also do so by clicking the unsubscribe link that features in every promotional mail sent by us.
We may pass your details to countries outside the UK and the European Economic Area for processing and arranging the requested products and services. And as you submit your booking/request with us, you give your consent to enable us to use, manage or share your personal information in this manner.
